La administración Trump demandada por crueldad intencional en el centro de detención de inmigrantes de Georgia
ATLANTA – MALDEF (Fondo Educativo y de Defensa Legal México-Estadounidense) y el bufete de abogados Eshman Begnaud dicen que han presentado una demanda en nombre de un inmigrante de Ecuador que fue detenido en el Centro de Detención del Condado de Irwin (ICDC) en Georgia. Los abogados dicen que el hombre de 25 años fue mantenido aislado en una celda pequeña durante meses, se le negó el tratamiento hormonal y se le impidió acceder a los recursos disponibles para todos los demás inmigrantes en las instalaciones, según la denuncia.
La demanda acusa a la administración Trump de infracciones bajo la Ley Federal de Reclamaciones por Agravios, una ley que permite a las personas buscar daños compensatorios del gobierno por negligencia e infligir intencionalmente angustia emocional.
Al demandante, que figura como “C.O.,” se le asignó el sexo de mujer al nacer, pero se ha identificado como hombre desde la infancia. En agosto de 2017, huyó de Ecuador y solicitó asilo al llegar al Aeropuerto Internacional Hartsfield-Jackson de Atlanta. Lo colocaron en remoción acelerada y finalmente lo llevaron al ICDC. Una vez allí, fue puesto inmediatamente en régimen de aislamiento. Permaneció allí durante seis meses, a veces pasando días con poco o ningún contacto humano. Durante ese tiempo su salud mental se deterioró, y en marzo de 2018 fue trasladado a un hospital psiquiátrico y posteriormente deportado ese mismo año.
En un comunicado de prensa de MALDEF, la demanda alega “C.O.” fue sometido a condiciones que violan los estándares federales de detención y las reglas federales, incluida la Ley de Eliminación de Violaciones en Prisión (PREA) que busca específicamente restringir el uso del confinamiento solitario como una forma de proteger a las personas vulnerables.
“CO. vino a los Estados Unidos en busca de refugio de la discriminación que enfrentó en su natal Ecuador como hombre transgénero,” dijo Adrián Hernández, abogado de plantilla de MALDEF. “En lugar de encontrar seguridad, C.O. se convirtió en otra víctima del cruel y discriminatorio régimen de detención de inmigrantes de los Estados Unidos. En el transcurso de varios meses, C.O. fue sometido a incomunicación indefinida y a la denegación de atención médica. Esta demanda es la única forma de responsabilizar a los EE. UU. Por no proporcionar condiciones humanas durante la detención y reparar el daño significativo que C.O. sufrido.”
El ICDC es una cárcel de inmigración operada por el condado de Irwin que tiene contratos con funcionarios federales. Ha atraído el escrutinio público luego de informes recientes de esterilización forzada de mujeres inmigrantes detenidas allí.
Trump Administration Sued Over Intentional Cruelty at Georgia Immigration Detention Center
ATLANTA – MALDEF (Mexican American Legal Defense and Educational Fund) and the law firm Eshman Begnaud say they have filed a the suit on behalf of an immigrant from Ecuador who was held at the Irwin County Detention Center (ICDC) in Georgia. Attorneys say the then 25-year-old man was kept isolated in a small cell for months on end, denied hormone treatment, and prevented from accessing resources available to all other immigrants at the facility, according to the complaint.
The lawsuit accuses the Trump administration of violations under the Federal Tort Claims Act, a law that allows individuals to seek compensatory damages from the government for negligence and intentional infliction of emotional distress.
The plaintiff, who is listed as “C.O.,” was assigned the sex of female at birth but has identified as male since childhood. In August 2017, he fled Ecuador and requested asylum upon arriving at Hartsfield-Jackson Atlanta International Airport. He was placed in expedited removal and eventually taken to ICDC. Once there, he was immediately put in solitary confinement. He remained there for six months, sometimes going days with little or no human contact. During that time his mental health deteriorated, and in March of 2018 he was transferred to a psychiatric hospital and later deported that same year.
In a press release from MALDEF, the lawsuit alleges “C.O.” was subjected to conditions that violate federal detention standards and federal rules, including the Prison Rape Elimination Act (PREA) that specifically seeks to restrict the use of solitary confinement as a way of protecting vulnerable individuals.
“C.O. came to the United States seeking refuge from the discrimination he faced in his native Ecuador as a transgender man,” said Adrian Hernandez, a staff attorney at MALDEF. “Rather than finding safety, C.O. became another victim of the United States’ callous and discriminatory immigration detention regime. Over the course of several months, C.O. was subjected to indefinite solitary confinement and denial of medical care. This lawsuit is the only way to hold the U.S. accountable for its failure to provide humane conditions in detention and to redress the significant harm C.O. suffered.”
The MALDEF press release describes ICDC as is an immigration jail operated by Irwin County that contracts with federal officials that has drawn public scrutiny following recent reports of forced sterilization of immigrant women held there.
