La ciudad llega a una resolución para preservar el roble patrimonial de Spring Street

PENSACOLA, Fla. – La ciudad de Pensacola llegó a un acuerdo con los propietarios del 605 N. Spring St. para preservar un roble vivo patrimonial que la ciudad ha tratado de proteger desde el 2019.

La acción de sentencia declaratoria presentada por la ciudad de Pensacola (2019 CA 1175) con respecto al roble vivo localizado en el 605 N. Spring St. se resolvió mediante un acuerdo con los propietarios. Los Vickery, propietarios de la propiedad en cuestión en el Distrito de Preservación de North Hill, acordaron preservar el roble vivo que se encuentra en la esquina noroeste de su lote en consideración al acuerdo de la Ciudad de Pensacola de reembolsarles los honorarios de sus abogados.

La ciudad ganó inicialmente cuando el juez de primera instancia emitió una orden judicial para preservar el árbol en espera del resultado de los argumentos relacionados con la aplicación de la Sección 163.045, Estatutos de Florida (2019). Los Vickery prevalecieron en la apelación ante el Tribunal de Apelaciones del Primer Distrito del Estado de Florida, y el asunto fue remitido al tribunal de primera instancia para continuar con los procedimientos. En septiembre del 2022, en presencia de los Vickery, se llevó a cabo una inspección del árbol por parte del Arbolista Maestro Certificado por la Junta de la ISA de la ciudad. Las partes sostienen que sus respectivas posiciones son meritorias, pero, en reconocimiento del costo de continuar con el litigio, las partes han llegado a un acuerdo para terminar todos los procedimientos.

Oak treePENSACOLA, Fla. – The City of Pensacola has reached an agreement with property owners at 605 N. Spring St. to preserve a heritage live oak tree that the city has sought to protect since 2019.

The declaratory judgment action filed by the City of Pensacola (2019 CA 1175) concerning the live oak tree at 605 N. Spring St. was resolved through an agreement with the property owners. The Vickery’s, who own the subject property in the North Hill Preservation District, have agreed to preserve the live oak found on the northwest corner of their lot in consideration of the City of Pensacola’s agreement to reimburse them for their attorneys’ fees.

The city prevailed initially when an injunction was entered by the trial judge to preserve the tree pending the outcome of the arguments concerning the application of Section 163.045, Florida Statutes (2019). The Vickery’s prevailed on appeal before the First District Court of Appeal of the State of Florida, and the matter was remanded to the trial court for further proceedings. An inspection of the tree by the city’s ISA Board Certified Master Arborist occurred in September 2022 in the presence of the Vickery’s. The parties maintain that their respective positions are meritorious, but, in recognition of the cost of continued litigation, the parties have come to an agreement to terminate all proceedings.
