Si lo detienen mientras conduce
Coopere, pero no dé información innecesaria
- Detenga su vehículo y encienda las luces de emergencia. Baje lentamente la ventanilla y coloque las manos en un lugar visible.
- Muestre su licencia*, registro y comprobante de seguro cuando un oficial se lo solicite. Si no tiene licencia de conducir, no muestre ningún documento falso.
- No responda preguntas relacionadas con su estatus migratorio ni sobre su país de origen.
- Tiene derecho a guardar silencio si así lo desea. Puede decir: “Quiero ejercer mi derecho a guardar silencio” y “Quiero hablar con un abogado.”
- Si el oficial le pide permiso para registrar su vehículo, tiene derecho a no consentir ningún registro. Diga: “No doy mi consentimiento para ningún registro.” El oficial no puede registrar su vehículo sin una orden judicial válida, a menos que exista una sospecha razonable. - La Patrulla Fronteriza puede detenerte si tiene una sospecha razonable de una infracción migratoria o un delito, y podría hacerte preguntas sobre tu estatus migratorio.
- No deben usar la raza ni la etnia como excusa para detenerte, así que si crees que esto está sucediendo, asegúrate de documentarlo.
- La Patrulla Fronteriza puede seguir deteniéndote para preguntar sobre tu estatus migratorio, pero no puede obligarte a hablar ni a firmar nada.
- Puede haber puestos de control de la Patrulla Fronteriza a menos de 160 kilómetros de cualquier frontera de EE. UU., incluidos los aeropuertos. Ten en cuenta que las costas de Florida forman parte de la frontera de EE. UU. y la Patrulla Fronteriza puede actuar en cualquier parte del estado.

If you are stopped while driving
Cooperate but do not give unnecessary information
- Stop your vehicle and turn on the emergency lights. Slowly lower the window and place your hands in a visible location.
- Show your license*, registration, and proof of insurance upon an officer’s request. If you don’t have a driver’s license do not show any false documents.
- Do not answer any questions related to your immigration status or about your country of origin.
- You have the right to remain silent if you choose to. You may say: “I want to exercise my right to remain silent” and “I want to speak with a lawyer.”
- If the officer asks for permission to search your vehicle, you have the right to not consent to any search. Say: “I do not consent to any search.” The officer cannot search your vehicle without a proper warrant from a judge, unless there is reasonable suspicion.
Watch out for border patrol
- Border Patrol can pull you over if they have reasonable suspicion of an immigration violation or a crime, and they may ask questions about your immigration status.
- They should not use race or ethnicity as a reason to stop you, so if you believe this is happening, make sure you document it.
- Border Patrol can continue to detain you to inquire about your immigration status, but they cannot force you to speak or to sign anything.
- Border Patrol checkpoints may exist within 100 miles of any U.S. border, including airports. Note that Florida shores are part of the U.S. border, and the Border Patrol can act anywhere in the state.
